Non-domiciled CDLs and English proficiency: what freightline tracks
How freightline tracks non-domiciled CDL lawful-status dates (I-94 admit until) under the 2026 FMCSA rule and logs English proficiency checks for your drivers.
Two federal changes affect who can drive for you. freightline doesn’t decide whether a driver qualifies — it keeps the dates and checks you record in one place and reminds you before they matter. This page is not legal advice; your state DMV and FMCSA have the final word.
Non-domiciled CDLs (2026 FMCSA rule)
FMCSA’s final rule “Restoring Integrity to the Issuance of Non-Domiciled CDLs” (91 FR 7044) was published on February 13, 2026 and took effect on March 16, 2026. Under it:
- States may issue or renew a non-domiciled CDL or CLP only for drivers in H-2A, H-2B or E-2 status.
- The license is valid only as long as the driver’s lawful status (the “admit until” date on Form I-94), and for no more than one year.
- States verify the driver’s status through the federal SAVE system.
- Holders of other statuses, including U4U parole and TPS, can’t renew a non-domiciled CDL.
Record it on the driver
- Open the driver and press Edit (or Add driver for a new one).
- In the CDL section, set CDL type to Non-domiciled. If the uploaded CDL is printed “NON-DOMICILED” or “NON-DOM”, AI sets this for you — check it anyway.
- Pick the Lawful status (H-2A, H-2B, E-2 or Other) and enter Status valid until (I-94 admit until).
- Save. The driver’s page now shows a Compliance card with the status date and any reminders.
What freightline flags
- The I-94 admit-until date 60, 30 and 7 days ahead, and once it has passed.
- A lawful status other than H-2A, H-2B or E-2: a non-domiciled CDL can’t be renewed for it under the 2026 rule — check with your state DMV.
- A non-domiciled CDL whose expiry date is later than the lawful-status date, since the status caps it.
Status dates show on the Compliance page next to CDL and medical card dates, and count toward “Driver docs expiring” in on the dashboard and in the Monday summary email (when email notifications are on).
